Cap-Gap Extensions for F-1 Students

The “cap-gap” extension is designed to extend F-1 status, and possibly any OPT or STEM Extension OPT authorization, of a student who is being sponsored by an employer for H-1B employment. Cap-gap benefits are available only if the following conditions are true:

  • The student is being sponsored by a cap-subject H-1B employer who has “timely filed” an H-1B petition to USCIS for the student. Typically, the employer must file the petition during the designated filing period (usually starting on or around April 1 and lasting for 90 days) following the end of the H-1B cap registration process (the "H-1B lottery") held in March.
  • The employer has requested a start date that falls within the fiscal year (October 1 - September 30) following the registration period. For example, the requested H-1B start date for a student selected in the March 2026 lottery should be within the fiscal year starting on October 1, 2026.
  • The employer submitted the H-1B petition to USCIS before the end of the student's OPT / STEM Extension OPT or before the end of their 60-day grace period following the end of their OPT / STEM Extension OPT. 
  • The employer's petition requests a “change of status” (from F-1 to H-1B) for the student. If the employer requested “consular processing" of an H-1B visa, the student will not be eligible for the cap-gap extension.

Please keep in mind that any questions regarding the H-1B petition must be answered by the sponsoring employer, not ISSS.
