Summary

The Department of Homeland Security published a final rule on ____ eliminating duration of status (D/S), fundamentally altering how the immigration status and activity of F-1 and J-1 students and scholars (and their dependents) is regulated. 

The rule becomes effective on _____. However, students and scholars currently in the U.S. will continue to operate under existing “duration of status” rules until there is a change in their program details.

What the Final Rule Does:

  • Students who enter the U.S. will be restricted to time-limited periods of stay based on their anticipated program length (e.g., 2 years for a master's), although any period of stay may not exceed more than four years at a time.
  • Any student who needs to request additional time beyond their existing period of authorized stay must apply for an extension not only with ISSS but also with the US Citizenship and Immigration Services
  • Students may also be able to depart the U.S. and re-enter, and seek an extension of time upon re-entry to the U.S.
  • Students may not complete more than one degree objective per academic level, such as one BA
